1. Acceptance of Terms

By accessing or using ByeByeApply ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and ByeByeApply. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Service Description

ByeByeApply is a career platform built around your forward-looking talent profile — what you want to do next, how you work best, and what you're looking for. Our service includes:

• An AI-guided onboarding conversation that helps you articulate your talent profile (superpower, work preferences, unique angle, what you're looking for)
• An anonymous talent profile that companies can discover via search and filter on ByeByeApply (no AI scoring, no algorithmic ranking)
• Tools for direct outreach to companies you want to engage with, including AI-assisted message drafting
• Activity tracking, follow-up reminders, and a Career Hub to organise your engagements

Important: ByeByeApply is a guidance and discovery tool, not a job placement service. We do not guarantee job offers, dialogues, or employment outcomes. Your success depends on your own efforts and qualifications.

3. User Accounts

3.1 Account Creation

To use ByeByeApply, you must create an account by providing a valid email address and password. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 16 years old to use ByeByeApply. By creating an account, you represent that you meet this age requirement.

3.3 Account Termination

You may delete your account at any time through your Privacy Settings. We may suspend or terminate your account if you violate these Terms or engage in prohibited activities.

4. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Harass, abuse, or harm other users or companies
• Impersonate any person or entity
• Transmit spam, viruses, or malicious code
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or extract data from the Service
• Use the Service to send unsolicited commercial messages
• Reverse engineer or decompile any part of the Service

5. User Content

5.1 Your Content

You retain ownership of all content you provide to ByeByeApply, including your preferences, notes, and outreach messages ("User Content"). By using the Service, you grant us a limited license to use your User Content to provide and improve the Service.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent that you have all necessary rights to share your User Content and that it does not violate any laws or third-party rights.

5.3 Content Moderation

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, but we have no obligation to monitor or moderate User Content.

6. AI-Generated Content

Our AI features (onboarding coaching, talent-profile drafting, JD analysis, and AI-assisted outreach message generation) help you express yourself and structure your engagement with companies. You acknowledge that:

• AI-generated content is provided "as is" without warranties
• AI-generated drafts may not always be accurate or suitable for your situation
• You should review and customise all AI-generated outreach messages before sending
• We are not responsible for outcomes resulting from following AI-generated suggestions
• AI models may occasionally produce unexpected or incorrect results

7. Company Data

Company information displayed on ByeByeApply is sourced from public registries (Brreg.no) and other publicly available sources. We strive for accuracy but cannot guarantee that all company information is current or complete. You should verify company details independently before taking action.

8. Privacy & Data Protection

Your use of ByeByeApply is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR.

Key Points:

• We store your email, preferences, and career data
• Your data is used to provide your talent profile and discovery experience
• We share data with third-party AI providers — Anthropic Claude as the primary sub-processor for onboarding coaching and talent-profile generation, with OpenAI and Groq as secondary and fallback providers for other AI features. All providers operate under signed Data Processing Agreements. See the Privacy Policy for the full sub-processor list.
• You can export or delete your data at any time
• We never sell your personal data

9. Intellectual Property

The ByeByeApply platform, including its design, code, AI models, and content, is owned by ByeByeApply and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of AI-generated content
• Warranties that the Service will result in job offers or employment

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYEBYEAPPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Failure to secure employment or job offers
• Damages resulting from use of AI-generated content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM (OR €100 IF YOU HAVE NOT PAID US).

12. Indemnification

You agree to indemnify and hold harmless ByeByeApply from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any laws or third-party rights
• Your User Content
• Your use of the Service

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and data (subject to our retention policies)
• Sections of these Terms that should survive termination will remain in effect

14. Governing Law & Disputes

These Terms are governed by the laws of Norway. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Norway.

Before filing any legal claim, you agree to first contact us at legal@byebyeapply.com to attempt to resolve the dispute informally.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through a prominent notice on our platform. Your continued use of ByeByeApply after changes constitutes acceptance of the updated Terms.
